1. WHO WE ARE AND WHAT THESE TERMS COVER
This store and website are operated by RICHOFPAIN, Viale Lombardia 233, 20861 Brugherio (MB), Italy. You can reach us at support@richofpain.com.
These Terms of Service govern your use of this website and every order you place on it. Our Shipping policy, Refund policy, Privacy policy and Legal notice are part of these Terms. By using this website or placing an order, you accept them.
These Terms are written in English, and English is the language of the contract between us.

2. WHO CAN BUY
You must be at least 18 years old, or of the age of majority where you live, to place an order. If you are younger, you may use this website only with the involvement of a parent or guardian.
You must give complete and accurate contact, delivery and payment information. If you create an account, you are responsible for keeping your credentials safe and for everything done through your account. You may not transfer or sell your account.

3. OUR PRODUCTS
Our garments are produced in limited drops. When a drop is sold out we are under no obligation to produce it again.
Our prints are applied by sublimation and by direct-to-garment printing. Small differences in the position, tone and finish of a print from one garment to another are a normal result of these processes and are not faults.
Size chart measurements are taken flat, by hand, and may vary by up to 2 cm. Colours may look different on your screen depending on your device and its settings.
Fibre composition, care instructions and country of origin are shown on each product page and on the label of the garment.

4. HOW AN ORDER IS FORMED
Placing an order is an offer to buy. The contract between us exists only when we send you the email confirming that your order has been dispatched. Until then, we may decline your order.
We may decline or cancel an order and refund it in full if the item is unavailable, if it was listed at an obviously incorrect price or description, if we cannot verify your payment or your address, or in the cases described in sections 5 and 6.

5. STOCK
We work hard to keep our stock figures accurate, but discrepancies can happen. If an item becomes unavailable after your order has been placed, we may cancel that item or the whole order and refund it in full.

6. ORDER LIMITS AND BOTS
We may limit the number of units of the same item that a single customer, address or payment method can order during a drop.
We may cancel and refund in full any order placed using bots, automated software or unauthorised checkout links, any order that exceeds those limits, any order we reasonably believe is placed for resale rather than personal use, and any order we reasonably believe to be fraudulent.
Please buy through this website directly when a drop goes live.

7. PRICES AND PAYMENT
Prices are shown in euro and include VAT where applicable. They do not include shipping, nor duties and import taxes for destinations outside the European Union: both are shown before you pay.
The price that applies to your order is the one displayed when you place it. Prices, promotions and descriptions may change at any time before an order is placed.
Payment is taken when you place your order, through the payment methods shown at checkout.

8. DISCOUNT CODES
Discount codes apply only while the promotion is running, cannot be combined with other codes unless we say so, cannot be applied to an order that has already been placed, and have no cash value. We may withdraw a code at any time, and we may cancel orders where a code has been used in a way it was not intended for.

9. SHIPPING AND DELIVERY
Shipping costs, delivery times, customs charges, and what happens to parcels that are refused, lost or not collected, are described in our Shipping policy, which forms part of these Terms.
Risk passes to you when you, or someone you have designated, take physical possession of the goods.

10. RETURNS, WITHDRAWAL AND GUARANTEE
Your right of withdrawal, the 2-year legal guarantee of conformity, and our own return conditions are described in our Refund policy, which forms part of these Terms.

11. INTELLECTUAL PROPERTY
Everything on this website — texts, photographs, images, graphics, garment designs, prints, and the RICHOFPAIN name and logo — belongs to RICHOFPAIN and is protected by copyright, trade mark and other intellectual property rights.
You may use this website for your own personal, non-commercial use. You may not copy, reproduce, resell, distribute or publish our content without our written permission, and you may not reproduce our prints or designs on garments of your own.

12. HOW YOU MAY NOT USE THIS WEBSITE
You may not use this website for any unlawful purpose, to breach anyone's rights, to send spam or malicious code, to scrape, crawl or copy the site, to impersonate anyone, to interfere with its security, or to harass anyone connected with it. We may suspend or close your access if you do.

13. CONTENT YOU SEND US
If you send us ideas, suggestions, reviews, photographs or other content, you give us a free, worldwide, transferable licence to use, reproduce, modify, publish and display it, including for promotion. You confirm that the content is yours to send and does not break anyone else's rights or any law. We are not obliged to publish it, to keep it confidential or to pay for it, and we may remove it.

14. THIRD-PARTY LINKS AND TOOLS
This website may link to, or use, services provided by third parties. We are not responsible for their content, their practices or their terms, and a link is not an endorsement. Please read their terms before using them.

15. RELATIONSHIP WITH SHOPIFY
This store is hosted by Shopify. Any purchase you make is made with RICHOFPAIN and not with Shopify, and Shopify is not responsible for it. Shopify processes personal information relating to your use of this website; our Privacy policy explains how.

16. PRIVACY
How we collect and use personal information is described in our Privacy policy.

17. ERRORS
This website may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, shipping charges, delivery times and availability. We may correct them, and update or cancel the orders affected by them, including after an order has been placed.

18. OUR LIABILITY
We are liable for damage caused by our failure to meet our obligations, in accordance with Italian law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited by law.
Beyond that, we are not liable for loss that was not foreseeable, for loss of profit, business or opportunity, or for delays caused by events outside our reasonable control, including courier delays, customs, strikes and extreme weather.

19. SUSPENSION AND CLOSURE
We may change, suspend or withdraw this website, in whole or in part, at any time. We may close your account or decline to serve you if you break these Terms. Sections 11, 13, 17, 18, 22 and 23 continue to apply afterwards.

20. CHANGES TO THESE TERMS
We may update these Terms. The version published on this page at the moment you place an order is the one that applies to that order.

21. GENERAL
If any provision of these Terms is found to be invalid, the rest continues to apply. If we do not enforce a right, we do not give it up. You may not transfer your rights under these Terms without our consent; we may transfer ours where this does not reduce your rights.

22. GOVERNING LAW AND COURTS
These Terms are governed by Italian law. If you are a consumer resident in the European Union, you also keep the protection of the mandatory rules of the law of your country of residence, and the competent court is the court of your place of residence or domicile.

23. YOUR CONSUMER RIGHTS
Nothing in these Terms limits or excludes any right you have under mandatory consumer protection law, including the rights of consumers resident in the European Union under the Italian Consumer Code (D.lgs 206/2005).
